Post-charge Diversion and Deferred Prosecution Program

Description: 
Generally, Deferred Agreements are either Deferred Conviction which would require the entry of a plea that is then held open, or Deferred Prosecution which involves an upfront dismissal without prejudice. The defendant is then required to complete conditions which may include AODA counseling, Anger Management, Mental Health counseling, obtaining a GED, paying restitution, etc. Additionally, all defendants must commit no new crimes during the time period. Individuals are monitored on a quarterly basis for compliance. Agreements are usually for 1 year but range from 6 months to two years. The agreements are written and signed and filed with the court once approved by the judge.
