Pre-arrest Diversion Program (Proxy)

Description: 
Law Enforcement officers in all jurisdictions in Chippewa County complete a proxy tool for all criminal arrests, ordinance violations with a state statute counterpart, and underage drinking violations. Officers may divert low to medium risk individuals with no prior arrests or convictions to the First Time Offender Program directly. This referral does not go through the District Attorney's office. The First Time Offender program is a one hour educational session regarding ramifications of citations/criminal violations and thought process leading to violations. First time underage drinking violators participate in a 4 hour evidence based education session regarding ramifications of underage drinking. Individuals must remain offense free during the duration of the program, 30-60 days. Successful participants avoid citation and criminal charges ad in most cases the offense remains off Wisconsin Circuit Court Access or is dismissed. There is a fee for the program.

Post-charge Diversion and Deferred Prosecution Program

Description: 
Chippewa County has a Post-charge treatment and diversion (Front-End Intervention Treatment - FIT) program which is a 12-24 month diversion program specifically designed for non-violent offenders for whom substance abuse is a contributing factor in their criminal activity. Offenders are diverted out of the criminal justice system in order to reduce placement on probation, in jail and prison. FIT allows for diversion of criminal charges while receiving treatment and services. The services provided in FIT are directly linked to the assessed risk level of the offender identified through a COMPAS assessment. FIT consists of phases and completion of programming identified through criminogenic need areas, such as a Cognitive Based Thinking Program, which has been proven to reduce recidivism. Case Management, random drug and alcohol testing, and treatment plan goals are dependent on risk level, needs, performance, and compliance. Upon successful completion charges are either dismissed or reduced. Chippewa County also has a Post-charge Deferred Prosecution program with less intense services. This is supervised by a service provider in the community.

Pretrial Program

Description: 
Chippewa County has been engaged with the Evidence-Based Decision Making Initiative since 2019. The goal is to build a system-wide framework (arrest through final disposition and discharge) that will result in more collaborative, evidence-based decision-making and practices in local criminal justice systems. CJCC and EBDM team members in Chippewa County believe implementation of this program will benefit citizens in our community. The mission is to reduce crime and improve the outcomes of the criminal justice system while maximizing the release of pretrial defendants, recognizing the presumption of innocence and the harmful effects of pretrial detention, maximizing public safety; and maximizing court appearance. Chippewa The PSA uses administrative data to produce two risk scores about a defendant: one predicting the likelihood the individual will commit a new crime if released pending trial, and another predicting the likelihood of failure to return to a future hearing.
