Post-charge Diversion and Deferred Prosecution Program

Description: 
Identified cases are selected by the DA's office to enter into an agreement, known as a Deferred Prosecution Agreement (DPA). In exchange for pleas to select charges, the offender is given an opportunity to avoid a conviction on those charges. If certain conditions are met within a stated time, the charges are ultimately reduced or dismissed. If the DPA is not complied with, the pleas are accepted by the Court, convictions entered and sentence imposed.

Bridgeways for Youth (BFY) is a youth diversion program that allows youth, ages 12-18, the opportunity to participate in short-term case management and educational programs as an alternative to receiving citations. Referral to BFY come from law enforcement under predetermined offenses. If a youth does not complete their program then the original charge(s) are submitted to Youth Justice. Depending on each participant's needs, the participant is connected to mental health and substance use treatment.

Pre-arrest Diversion Program (Proxy)

Description: 
Pathways is a voluntary diversion program that provides support to individuals 17 and older seeking assistance in stopping their drug use. Pathways referrals are received from law enforcement, community members, or self-referrals. Those individuals referred by law enforcement have the opportunity to participate in the program as an alternative to receiving citations or, in some cases, jail time. Eligible individuals are required to participate in drug treatment and case management services. Deflection refers to any collaborative intervention connecting law enforcement, other first responders, and community responders with public health systems to create pathways to treatment and services for non-violent individuals with low to moderate criminogenic risk, who have substance use disorder, mental health disorder, or co-occurring disorders, and who often have other service needs. These needs may include treatment, recovery support, mental health services, community resources, and case management. Deflection is not an appropriate program option for high-risk individuals that have been through the justice system many times already.
