Post-charge Diversion and Deferred Prosecution Program
Description:
The Domestic Violence Fast Track program targets offenders that have not previously been charged with a domestic offense. The assigned prosecutor reviews the case and if appropriate will offer the fast track program. The purpose of the program is to hold the Initial Appearances in front of a Circuit Court Judge so that, if the defendant is in agreement, they can be sentenced at their first appearance. There is staff from our domestic abuse shelter, Harbor House to set up appointments for the Domestic Abuse Screening that are required. This allows the defendants to get the assessments and start any follow up much faster than the traditional court process. The defendants are offered a 12 to 18 month Deferred Prosecution Agreement.

Pre-charge Diversion Program
Description:
The 17-year old Young Adult Offender program (YAO) is a collaboration between the Outagamie County District Attorney’s Office and the Department of Youth and Family Services (YFS). The purpose of the program is to try and keep this group of offenders out of the adult system and off of CCAP. All 17-year old referrals are prescreened by the District Attorney’s Office and those that do not pose immediate risk to the community are sent to YFS for an intake appointment and assessment. If appropriate, they are placed on a 1 year Deferred Prosecution Agreement with conditions deemed appropriate by the assigned Intake Worker. If YFS feels the offender is not appropriate or they violate their conditions, the referral is sent back to the District Attorney’s Office and the case can be formally charged out. If the Offender successfully completes the program, charges are never filed. The Young Adult Offender program was expanded to 18-year olds in March of 2016 and to 19-year olds in September of 2016. The 18-year old and 19-year old program has the same purpose as the 17-year old program. The supervision of 18-year old and 19-year old offenders is managed by the Criminal Justice Treatment Services Department (CJTS). CJTS screens and assesses all 18-year old and 19-year old offenders for program appropriateness. CJTS and Youth and Family Services collaborate to provided services to these offenders. CJTS will refer inappropriate candidates or participants that violate their conditions back to the District Attorney's Office. If the offender successfully completes the program, charges are never filed.

Pretrial Program

Description:
In 2008 the National Institute of Corrections (NIC) launched the Evidence-Based Decision Making (EBDM) Initiative, and Outagamie County's criminal justice system was phased into that initiative in early 2015. Following completion of Phase V of the EBDM Initiative, it became clear that the state and local EBDM teams shared a similar goal to develop/expand their pretrial systems, resulting in launch of Wisconsin's Pretrial Pilot Project were launched. In 2017 Criminal Justice Treatment Services (CJTS) took over the operations of the Day Report Center from the contracted community provider and improved the program's functions to accommodate an evidence-based pretrial assessment and supervision program. Pretrial assessments were initially completed utilizing the Wisconsin Pretrial Risk II tool on all individuals in custody who are subject to a pretrial release/detention decision by a judicial officer. Outagamie County transitioned to the PSA in June 2019.
